5. User Content and Intellectual Property

Platform Intellectual Property

All intellectual property rights in the Site, the Service, and all content provided by PixMythos, including but not limited to software, text, graphics, logos, and trademarks, are owned by PixMythos or its licensors. Except as expressly provided in these Terms, you have no rights or licenses in or to these materials.

User Input

Users and/or the original rights holders retain ownership and intellectual property rights in their input content.

• Using the Service does not change or transfer those rights.
• You represent and warrant that you have all necessary rights to upload or input all materials you submit.
• You will comply with our Acceptable Use Policy when submitting prompts, uploading images, and generating content.

Generated Content

As between PixMythos and the user, all right, title, and interest in generated content belong to the user.

Legal notice: Ownership of AI-generated content is still evolving under the law. Except for the limited license described below, PixMythos does not claim any independent intellectual property ownership in user-generated content.

You are solely responsible for all content you generate using the Service.

6. AI-Generated Content Disclaimer

No Guarantee of Output

PixMythos does not guarantee the accuracy, completeness, legality, or fitness of AI-generated content.

• AI outputs may contain errors, bias, or inaccuracies.
• AI outputs do not represent the views or positions of PixMythos.

Third-Party Rights

PixMythos does not guarantee that generated content will not infringe any third-party intellectual property or other rights.

• AI outputs may unintentionally resemble copyrighted works.
• You are responsible for verifying potential copyright risks before using generated content, especially for commercial purposes.

User Responsibility

You are solely responsible for your use of generated content.

• PixMythos is not liable for any third-party claims arising from your use of generated content.
• We recommend independent verification before using generated content for important or commercial purposes.
• Your use of generated content must comply with our Acceptable Use Policy.

7. Subscription Management and Billing

Finality of Payment

All payments for subscriptions, top-ups, or other paid features are final. Once you obtain paid services or top-up credits, the services are deemed to have begun, and the relevant fees are non-refundable unless otherwise provided in these Terms or required by applicable law.

Subscriptions and Auto-Renewal

PixMythos offers monthly and annual subscription plans:

• Auto-renewal: Unless you cancel at least 24 hours before the end of the current billing cycle, your subscription will automatically renew.
• How to cancel: You may cancel your subscription at any time from your account management page.
• Service after cancellation: After you cancel, you may continue to use the Service until the end of the current subscription period, but paid fees will not be refunded.

Nothing in these Terms affects any mandatory cancellation rights available to you under applicable law.

8. Refund Policy

General Principles

Unless otherwise required by law or expressly provided in these Terms, all payments are final, non-refundable, and non-transferable. Unused subscription periods, credits, or quotas are not refundable and will not be credited to your account.

We understand that this may differ from your expectations. However, because these are digital services, once the service has begun, we cannot “take back” the service content already delivered.

AI Output Quality

Under Section 6, you acknowledge that the PixMythos Service is based on artificial intelligence technology. Due to the probabilistic nature of AI, generated outputs may not meet your expectations.

Please note: subjective dissatisfaction with generated results, including but not limited to style preferences, creative direction, or personal aesthetics, does not constitute a service defect and is not a valid basis for a refund.

We recommend fully testing the free features before subscribing to ensure that the Service meets your needs.

Statutory Rights in Certain Regions

EU/UK users: If you are a consumer residing in the EU or UK, you generally have a 14-day statutory right of withdrawal. However, once you use PixMythos to generate any content, you expressly agree that we may begin performing the contract immediately, and you acknowledge that you thereby waive your right of withdrawal.

Refund Restrictions

To maintain the fairness and sustainability of the Service, we reserve the right to refuse a refund in the following circumstances:

• You have actually used the purchased service or consumed credits.
• Your account has been restricted, suspended, or terminated for policy violations, abuse, or fraud.
• You have previously received a refund for a similar reason.
• You purchased the service through a promotion, coupon, or discounted price.
• Your refund request is outside the applicable period.

PixMythos reserves final discretion to approve or deny refund requests in order to ensure consistency with platform policies and prevent abuse.

Special Refund Circumstances

In the following objective circumstances, we may consider a refund or compensation:

• A platform technical failure causes the Service to be completely unavailable for more than 72 consecutive hours.
• An obvious system billing error, such as a duplicate charge.
• Other circumstances expressly required by applicable law.

How to Request a Refund

To request a refund, please email support@aiphotocombiner.app and provide the following information:

• Your account information, including your registered email.
• Proof of payment, such as a transaction screenshot or receipt.
• The reason for your refund request.

We will review your request and respond within 15 business days after receiving your email.

Disputes and Chargebacks

If you have any questions about a charge, please contact us first. We aim to resolve any payment dispute through friendly communication.

If a user initiates a chargeback directly with their bank or payment processor without first contacting PixMythos support:

1. Account suspension: Your account will be suspended immediately until the dispute is resolved.
2. Evidence submission: We will submit your usage records and these Terms to the payment institution as supporting evidence.
3. Fee responsibility: If a chargeback is determined to be invalid or malicious, you may be responsible for related administrative fees.

We encourage you to resolve the matter through direct communication. In most cases, we can handle your request more quickly and smoothly than a bank or payment processor can.

Abuse and Fraudulent Refund Requests

PixMythos is committed to providing a fair service environment for all users. We consider the following conduct to be abusive or fraudulent refund requests:

• Requesting a full or unconditional refund after extensive use of the Service, such as after using most of your credits or generating a large amount of content.
• Repeatedly registering new accounts to abuse trials, first-purchase discounts, or the refund policy.
• Providing false or misleading information to obtain a refund.
• Attempting to continue accessing or using the Service after receiving a refund.

Our response: For the conduct described above, PixMythos reserves the right to:

1. Refuse the refund request and provide detailed usage records as support.
2. Permanently terminate the account without restoration.
3. Contest malicious chargebacks and submit complete evidence to the payment institution.
4. Recover losses, including administrative costs incurred in handling the abusive conduct.

Litigation: In serious cases involving fraud, organized abuse, or significant loss, PixMythos reserves the right to pursue legal remedies, including civil litigation and reporting the matter to law enforcement.

We believe that most users use the Service in good faith. These provisions are intended to protect the legitimate rights and interests of the platform and other users and to ensure the long-term sustainability of the Service.

9. Fraud, Abuse, and Content Violations

Prohibited Conduct

The following conduct constitutes fraud or abuse:

• Using stolen or unauthorized payment methods.
• Exploiting system vulnerabilities to obtain free services or features.
• Making malicious refund requests or initiating malicious chargebacks.
• Creating multiple accounts to abuse free trials or promotional offers.
• Reselling or distributing account access without authorization.
• Generating, uploading, or attempting to generate content prohibited by our Acceptable Use Policy.
• Circumventing, disabling, or attempting to evade content filters or moderation measures.
• Submitting knowingly false or malicious abuse reports.

Content Violations

We may remove or restrict access to content, block further generation, suspend or terminate accounts, and take the other enforcement actions described in the Acceptable Use Policy if we reasonably believe that content or conduct violates that policy. Serious violations may also be reported to law enforcement or other competent authorities.

Enforcement Measures

If we discover fraud or abuse, we may:

• Immediately suspend or terminate your account.
• Revoke any services or credits obtained through fraudulent means.
• Remove content and forfeit credits associated with violating activity.
• Seek recovery for any losses.
• Report the matter to the relevant law enforcement authorities.

Chargeback Disputes

If you dispute a charge, please contact us first so that we can try to resolve the issue.

Initiating a chargeback without a good-faith attempt to resolve the issue may result in account termination.

We reserve the right to take legal action against malicious chargebacks.

Third-Party Service Providers

• Any errors will be corrected.

Disclaimer

To the maximum extent permitted by law, PixMythos expressly disclaims all warranties, including but not limited to:

• Merchantability.
• Fitness for a particular purpose.
• Non-infringement.

Disclaimer of Indirect Damages

PixMythos is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data loss, or loss of use, whether based on warranty, contract, tort, or any other legal theory, even if PixMythos has been advised of the possibility of such damages.

Maximum Compensation Cap

For any claim arising from your use of the Service, PixMythos’s total liability to you shall not exceed the total fees you paid to PixMythos in the 12 months before the claim arose.

13. Indemnification

You agree to indemnify, defend, and hold harmless PixMythos from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

• Your use of the Service.
• Your violation of these Terms.
• Your infringement of any third-party intellectual property or other rights.
• Content you upload or generate.

14. Termination

User Termination

You may terminate your account at any time by following the instructions on the Site. Upon account termination, your right to access and use the Service will terminate immediately.

Platform Termination

PixMythos may terminate or suspend your account or access to the Service for any reason, including but not limited to your violation of these Terms or the Acceptable Use Policy, with or without prior notice.

Effect of Termination

• All licenses granted to you under these Terms will immediately terminate.
• You must stop using the Service.
• Paid fees are non-refundable unless required by applicable law.
